     In every school, daycare center etc. the teacher has a huge responsiblitiy and very student in their care have certain rights. Special needs children have rights and responsiblities; but these rights have not been important.

It's a long journey to receive special education;but it starts with first the teacher giving a referral. This is normally iniated by th egenreal educator;but can be also done by the parents/guardian. After the referral if the student is eligible;the child with the special need will have an individual education program(IEP) put together. The IEP must contain current performance, goals, special education and related services, dates, transitional services measure of progress and age of majority. Child under the age of 5 years old will receive an individual family service plan (IFSP)this caters to infants and toddlers to help transition to school at age 5.

     The IEP/IFSP teams decides what will be taught and where the educational instruction for the child will be. It is the responsiblity of the teacher to choose the appropriate place that provides the student with the least restrictive setting. This allows him/her to acheive the goals set on the IEP/IFSP. The teacher and school will hav eto follow all mandated laws stated by the Federal Government in IDEA/IDEA 2004.

 

     The rights that the student with disabilities have are alot.They have the right to be placed in a least restrictive environment(LRE). They have the right to an education like students that don't have a disability. They should be able to be educated in an environment as close as possible to general education classroom. The parents have the right to be involved in the desesion making regarding their child with special needs. They have the right to have accomendations for the particular disability.

 

     With the cooperation of parents/guardian, teachers and the school system the problems the child with a disability faces should not be so that they can't be productive in their school setting and be ready to transition out into society.
